A Caucasian couple was dismayed after finding out that the sperm bank accidentally used the sperm of a black man resulting to a baby of mixed race. Jennifer Cramblett filed a legal case against Illinois Sperm Bank last year. However, the court threw her case and suggested filing a new one under a negligence claim. Her case was filed under the 'Wrongful birth' case.
When the couple opted for artificial insemination to have their own child in 2011, they chose a donor who is blonde and has blue eyes. After nine months, they were shocked to see their child who is far from what they are expecting. Peyton, now three years old, has black curly hair and dark skin. When the mistake was discovered, the sperm bank issued an apology letter and partial refund of their payment.
Though Jennifer says she loves her biracial child, she claims that she is not culturally prepared to raise her, reports The Guardian. According to her, she was raised in Uniontown where she was taught about stereotypical attitude towards minorities and she has a limited cultural competency to deal with African-Americans.
She added that they are thinking of moving to a place where people are open to accepting Peyton. Meanwhile, Bob Summers, an attorney for the sperm bank reiterated that the claim of the couple for 'wrongful birth' may not be plausible because she gave birth to a healthy child, reports Mail Online.
Wrongful birth means that a child or infant was born with congenital disease or hereditary disorders that the sperm bank neglected to test.
She is firm in her decision to re-file the case against the sperm bank.
"I am happy that I have a healthy child. We love her more... to this day, she's made us the people that we are. Never trade it for the world," she told Mirror.co.uk.
"But I'm not going to let them get away with not being held accountable."
